Foundational study guides: route orientation, study method and original worked practice. These are not a complete examination syllabus, an eligibility decision, regulator-endorsed training or a newly activated paid LMS course. Verify your individual requirements and examination session with the responsible regulator before committing money or making an application.

Chapter 1

Choose the correct applicant route

A lawyer fully admitted without restriction in a foreign jurisdiction may qualify for the California examination without additional United States legal study under the State Bar's foreign-admitted route. A person holding a foreign law degree but not admitted must examine the separate education route. Registration, supporting evidence and examination application are distinct tasks.

Foreign admission alone does not establish eligibility for California's shorter Attorneys' Examination; the State Bar's qualifying United States-admission requirements must be checked. Examination success also does not eliminate character or other admission requirements.

For future preparation, record the July 2028 NextGen transition separately from the proposed California-specific component contemplated for July 2029. The court requested a proposal for the latter rather than publishing a final syllabus in that announcement. Plan from the official specification for the actual examination you will sit.

Chapter 2

Build issue-by-issue essay discipline

For every practice answer, begin with an issue list before writing a narrative. Under each issue, identify the supplied rule, facts supporting the proposition, facts undermining it, a provisional conclusion and the consequence for the client. This structure reveals gaps that can be hidden by a long general discussion.

Keep general legal concepts and jurisdiction-specific variations in separate notes. A rule learned for another examination should not silently replace the applicable California source. Use the current official examination outline to select topics; this guide is an analytical foundation rather than an exhaustive content list.

In a timed exercise, allocate a short initial period to task reading and a short final period to checking. Record the error you actually made: overlooking a condition, adding an unstated fact, failing to discuss an exception or answering outside scope. Rework the same problem after changing one material fact and explain precisely why the conclusion changes.

Chapter 3

Original practice — a confidential document sent by mistake

Use only this fictional professional-conduct packet: a recipient who reasonably recognises that a document was sent by mistake must notify the sender promptly, stop examining it pending resolution and preserve a record of what happened. The packet does not authorise destruction or distribution. These are assumed training rules, not a complete account of California professional obligations.

During negotiations, opposing counsel emails a file named 'internal settlement limits'. The first page contains the opponent's confidential negotiating ceiling. Your client asks you to forward it immediately and says that anything received by email is fair to use. The sender has not yet noticed the mistake.

Draft an action note for a supervising lawyer, then a client-facing explanation. Separate the immediate handling steps from the later legal determination about use of the document. Identify why the client's commercial preference cannot by itself answer the professional-conduct issue.

Attempt first, then compare

Write your own response before revealing the explanation. Identify which facts activate the supplied rule and where further evidence is needed.

Reveal the worked model answer

The filename and first-page content give reason to recognise an inadvertent transmission. Under the assumed packet, stop reviewing, promptly notify the sender and document receipt, the limited review already undertaken and the preservation steps. Do not forward the file to the client or destroy it.

Ask the supervisor to determine the applicable law and procedure before any further use. The packet does not conclusively resolve every privilege or admissibility question, so the answer should not claim that the material is automatically usable or permanently unusable. Explain to the client that professional handling duties apply independently of a perceived negotiating advantage.

Check your understanding

1. Should every foreign law graduate be placed in the foreign-admitted attorney route?

No. Holding a degree and holding unrestricted professional admission are different facts.

2. What is approved for July 2028?

California's move to the NextGen Uniform Bar Exam; the later state-specific component requires separate confirmation.

3. Does the exercise permit forwarding the document before seeking advice?

No. The assumed packet requires notification, restraint and preservation rather than distribution.

Your next assignment

Prepare a route checklist and three 200-word issue analyses. Keep examination-format notices separate from substantive-law notes so a transition announcement does not become an invented legal rule.

Review your work for five things: correct issue, accurate source or supplied rule, relevant facts, reasoned conclusion and a practical next step. Use fictional or anonymised facts, not confidential client documents.
