Chapter 1
Education route and score route must both work
Applicants relying on foreign or non-ABA legal education should examine Rule 46 and the Committee's guidance on the applicable 26-credit requirement. Check the institution and the content of proposed courses against the current rule; do not assume that any collection of United States credits is sufficient.
D.C.'s announced first administration of NextGen is February 2028. Its notices about accepting transferred scores concern a different route. A score that appears portable does not, by itself, decide the applicant's education, character or other admission requirements.
Suggested planning exercise: prepare two independent checklists, one for educational eligibility and one for the proposed examination or transfer route. Link each conclusion to a specific current notice or written decision. Mark a course as unverified until its suitability is actually established rather than inferred from the course title.

Chapter 2
Read a legal file as a decision problem
Before reading a case packet, identify the requested deliverable: an objective memorandum, a persuasive submission, a client letter or a proposed agreement. The same facts can support different writing choices, but the task instruction determines which choices are useful.
Create a chronology, then an issue matrix. For each disputed event, note the available evidence, who supplied it and whether its reliability is contested. Treat missing documents as investigation tasks. A strong answer explains what can be decided now and what must remain provisional.
Practise a short recommendation with a stated level of confidence. Include the strongest counterargument and a practical next step. When learning for an examination using supplied legal resources, the disciplined use of those resources matters more than displaying knowledge of an unrelated jurisdiction. This exercise is generic skills practice, not a prediction of an official paper.

Chapter 3
Original practice — an administrative permit refusal
Assume the fictional permit rule says a decision-maker must consider all timely representations and give reasons addressing any decisive disputed fact. It does not require an oral hearing in every case. A reviewing body may return the matter for reconsideration but may not issue the permit itself.
A small publisher submits a permit request. Before the deadline, it emails evidence correcting an adverse inspection report. The final refusal simply repeats the report and says 'all objections considered'. The file index does not list the correction. The client wants a reviewing body to award the permit immediately.
Write a 200-word review recommendation that separates a possible reasoning or consideration defect from the merits of the permit. State what evidence you would seek and what remedy the supplied rule permits. Explain why the absence of an oral hearing is not enough, by itself, to establish a breach of this packet.

Attempt first, then compare
Write your own response before revealing the explanation. Identify which facts activate the supplied rule and where further evidence is needed.
Reveal the worked model answer
The key concern is whether the timely correction was considered and whether reasons address the decisive factual dispute. The missing index entry and repeated report justify further enquiry but are not conclusive proof that the correction was ignored. Obtain delivery records, the complete administrative record and the actual reasons.
The assumed rule does not confer a universal oral-hearing right. Focus the argument on consideration and reasons rather than inventing that requirement. The permitted remedy is reconsideration, not direct issuance of the permit. Explain that procedural relief can reopen a decision without guaranteeing a favourable substantive outcome.
Check your understanding
1. Is D.C.'s first NextGen administration July 2028?
No. The D.C. announcement specifies February 2028.
2. Does a potentially transferable score settle the education requirement?
No. Verify the route's education and other admission conditions independently.
3. What remedy is available in the fictional exercise?
Return for reconsideration; the reviewing body cannot itself issue the permit under the assumed rule.
Your next assignment
Complete one education-and-score route matrix and one objective record-based memorandum. For every proposition, distinguish a confirmed fact, a reasonable inference and an unresolved issue.
Review your work for five things: correct issue, accurate source or supplied rule, relevant facts, reasoned conclusion and a practical next step. Use fictional or anonymised facts, not confidential client documents.
