New York Bar — foreign education, examination route and legal analysis
Build an eligibility evidence file and a session-specific preparation plan without assuming that any overseas LLB or LLM automatically qualifies.

Foundational study guides: route orientation, study method and original worked practice. These are not a complete examination syllabus, an eligibility decision, regulator-endorsed training or a newly activated paid LMS course. Verify your individual requirements and examination session with the responsible regulator before committing money or making an application.
Chapter 1
Foreign evaluation is a separate decision
Foreign-educated applicants need an advance evaluation under the Board's Rule 520.6 process. Duration, substantive equivalence and recognition of legal education matter. An LLM is not a universal cure for any educational deficiency; the Board's conditions and the particular deficiency must be checked before choosing additional study.
Examination eligibility and eventual admission are different stages. Track the Board's examination requirements and the other New York admission components separately. New York's announced NextGen start is July 2028; a NextGen score from an earlier administration in another jurisdiction is not accepted for transfer to New York under its published notice.
Suggested evidence exercise: arrange degree certificates, transcripts, programme dates, course descriptions and official correspondence in an indexed file. For each item, record whether it was supplied by you or must come directly from an institution. A missing institutional verification is not repaired by an attractive personal summary.

Chapter 2
A preparation map that follows the selected examination
Begin with the official content outline for your intended session, not a generic United States bar-preparation list. Divide your work into substantive understanding, multiple-choice discrimination, analysis and written work. For each topic, record the governing source, one application problem, one exception and one recurring mistake.
For a legal memorandum, keep a fact-and-authority matrix. Put the client's helpful facts in one column and the adverse facts in another. Against each, identify the proposition it supports. Write the strongest argument on both sides before choosing a conclusion; a conclusion without a reasoned treatment of adverse facts is not a complete analysis.
When working from a supplied library of authorities, read the task instruction first. Separate binding propositions in the exercise from background narrative. Do not cite a case you cannot locate or invent a quotation. Review the finished answer for the requested audience, format, word budget and unresolved factual assumptions.

Chapter 3
Original practice — contract formation and an alleged acceptance
Fictional training rules only: an offer can be accepted by a communicated, unconditional agreement before expiry. A response changing an essential term is a counter-offer. Silence is not acceptance. These rules are supplied for this exercise and do not purport to summarise all New York contract law.
A supplier offers 100 chairs at 50 units of currency each, delivered by 30 June. The offer expires at 17:00 on 1 June. At 16:00 the buyer replies, 'Accepted, provided delivery is by 20 June.' The supplier does not respond. On 2 June the buyer sends the price and claims that a contract already exists.
Write an objective memorandum distinguishing an unconditional acceptance from a counter-offer. Identify which essential term changed, explain why payment on 2 June does not itself establish acceptance under the packet, and specify what further communication would be relevant. Add a separate two-sentence client explanation.

Attempt first, then compare
Write your own response before revealing the explanation. Identify which facts activate the supplied rule and where further evidence is needed.
Reveal the worked model answer
The purported acceptance changes the delivery date from 30 June to 20 June and expressly makes agreement conditional on that change. Under the supplied rules, it is a counter-offer rather than acceptance of the original offer. The supplier's silence does not accept it.
The subsequent payment establishes an act by the buyer, not a communicated unconditional agreement by the supplier. Obtain any later messages, refund response or affirmative acceptance, without inventing a rule about acceptance by conduct that the packet does not provide. Tell the client that the present documents do not establish the asserted agreement on the supplied rules; further communications may alter the analysis.
Check your understanding
1. Is buying an LLM the same as obtaining a Rule 520.6 eligibility decision?
No. The individual educational evaluation and any permitted remedial route must be established first.
2. Can a July 2026 NextGen result be assumed transferable to New York?
No. New York's published notice excludes NextGen examinations administered before July 2028.
3. Which fact makes the response conditional?
The express requirement to change the delivery date to 20 June.
Your next assignment
Produce a one-page eligibility gap analysis and a separate study timetable for the intended examination session. Do not combine regulatory confirmation, course purchase and examination registration into a single unchecked step.
Review your work for five things: correct issue, accurate source or supplied rule, relevant facts, reasoned conclusion and a practical next step. Use fictional or anonymised facts, not confidential client documents.
