Start Course Tutor with Auto audio on: it teaches continuously, answers a typed question, then resumes. A Hindu undivided family (HUF), a firm or an association of persons is resident unless the control and management of its affairs is situated wholly outside India. A resident HUF is ROR or RNOR according to the status of its karta (manager). Problem 3: Company. A company incorporated in Singapore holds all board meetings in Singapore, but in practice every key commercial decision is taken by its promoters in Mumbai and the Singapore board merely approves them. Reasoning: the POEM test looks at substance, not the place of formal meetings. Key decisions are, in substance, made in India, so the company is likely to be resident in India for that year. Which mistake would change the reasoning in this example? 1. Deciding residence by citizenship or passport. Correction: residence depends on physical stay and the statutory tests for each year. 2. Stopping at "resident" for an individual. Correction: always go on to decide ROR or RNOR, because the scope differs. Ask Course Tutor: please explain this step from the example. Reasoning: the POEM test looks at substance, not the place of formal meetings. Why does it follow? Add what you tried, so the explanation addresses your difficulty. Now try the source practice. What does POEM mean? Pause before the answer. The source answer is: The place where key management and commercial decisions necessary for the conduct of the company's business as a whole are, in substance, made. Explain the key idea in your own words, revisit any mistaken step, then continue to the next lesson. Use Stop to end Course Tutor when you finish.
