Welcome to UGC NET Law (058). We will study Jurisprudence I: identifying law, analysing rights and recognising legal persons, work through an example, and practise using the course's learning material. Paper I + Paper II (Law 058) specialisation pathway. Sign in and use the study header to open your authorised course. Select this published lesson. Start Course Tutor with Auto audio on: it teaches continuously, answers a typed question, then resumes. 1. Effectiveness has been mistaken for legal validity. Compliance is evidence about operation; authority, competence and applicable validity rules must still be examined. 2. The report is a material or historical source of the content. The legally competent enactment is the formal source of the statutory norm. The report may assist interpretation without being legislation. Worked example. Three shareholders incorporate a company. The company buys equipment using its bank account. A shareholder cannot simply treat one third of each machine as personally owned property and sell it. Ownership of shares and ownership of company assets are different legal relations. If the shareholder personally guarantees a company debt, the separate guarantee may create a personal obligation; incorporation has not erased it. Ask Course Tutor: please explain this step from the example. Ownership of shares and ownership of company assets are different legal relations. Why does it follow? Add what you tried, so the explanation addresses your difficulty. Now try the source practice. A legal system recognises a constitutional equality standard. Does that fact alone prove that all positivist theories are false? Explain. Pause before the answer. The source answer is: No. Inclusive positivism can explain incorporation through recognised legal criteria; competing theories differ about the role and basis of morality. A moral criterion in the text is not a complete argument against every positivist account. Explain the key idea in your own words, revisit any mistaken step, then continue to the next lesson. Use Stop to end Course Tutor when you finish.
