Welcome to Judiciary Mains Answer Writing. We will study Anatomy of a Judiciary Mains Answer: Issue, Rule, Application and Conclusion, work through an example, and practise using the course's learning material. Structured mains answer-writing practice for judicial service examinations. Sign in and use the study header to open your authorised course. Select this published lesson. Start Course Tutor with Auto audio on: it teaches continuously, answers a typed question, then resumes. A judiciary mains paper (Civil Judge / Judicial Magistrate examinations conducted by State Public Service Commissions and High Courts) is not a test of how much law you can copy from memory. Question. P, a tenant, sub-lets part of the premises to Q without the landlord's written consent. The landlord R sues for eviction under the applicable State rent law and also claims damages. Q says he was unaware of any restriction. Advise the court on the points for determination. Issue. (i) Whether the tenancy terms or the applicable rent statute prohibit sub-letting without written consent; (ii) whether sub-letting has been proved; (iii) whether Q's lack of knowledge is a defence; (iv) whether damages are recoverable in addition to eviction. Rule. Most State rent control statutes make unauthorised sub-letting a ground for eviction; the exact provision and wording must be taken from the statute in force in the State of the examination. Under the Transfer of Property Act, 1882, section 108 governs rights and liabilities of lessor and lessee subject to contract to the contrary. Application. R must prove that Q is in exclusive possession of a part and pays P for it; mere presence of a relative or employee is not sub-letting. If exclusive possession for consideration is shown, Q's ignorance is irrelevant because the ground concerns the tenant's act, not the sub-tenant's knowledge. Damages depend on proof of loss and on whether the special statute limits the civil court's jurisdiction. Conclusion. Eviction is available on proof of exclusive possession for consideration without written consent; Q's plea of ignorance fails; damages lie only if loss is proved and the statute does not bar them. Why this scores. Every issue is answered separately, the rule is sourced, and the application uses the facts (exclusive possession, consideration, consent) instead of reciting law. Which mistake would change the reasoning in this example? 1. Writing everything you know about the topic. Correction: select only the rules the facts actually engage, and say briefly why other rules do not apply. 2. Skipping the issue statement. Ask Course Tutor: please explain this step from the example. Under the Transfer of Property Act, 1882, section 108 governs rights and liabilities of lessor and lessee subject to contract to the contrary. Why does it follow? Add what you tried, so the explanation addresses your difficulty. Now try the source practice. What is the difference between the rule step and the application step? Pause before the answer. The source answer is: The rule step states the legal proposition and its source; the application step shows how the specific facts satisfy or fail each element of that proposition. Explain the key idea in your own words, revisit any mistaken step, then continue to the next lesson. Use Stop to end Course Tutor when you finish.
