Welcome to Judiciary Prelims Test Series. We will study Constitution I: "State" under Article 12 and the Equality Tests of Article 14, work through an example, and practise using the course's learning material. Objective practice and timed test support for judiciary preliminary examinations. Sign in and use the study header to open your authorised course. Select this published lesson. Start Course Tutor with Auto audio on: it teaches continuously, answers a typed question, then resumes. The present test. A seven-judge Bench in Pradeep Kumar Biswas v. Indian Institute of Chemical Biology (2002) restated the law: the question is whether the body is financially, functionally and administratively dominated by or under the control of Government. Example 1 — Is it "State"? A cooperative bank is registered under a State Cooperative Societies Act. The Government holds no shares, gives no grants and appoints no directors; the Registrar's supervision is the same as for every cooperative society. An employee dismissed without inquiry files a writ under Article 32 alleging violation of Article 14. Reasoning: Apply Pradeep Kumar Biswas. Financial control: none. Functional control: banking is a commercial activity, not a governmental function. Administrative control: only general statutory regulation, which is not deep and pervasive control. The bank is not "State" under Article 12, so a petition under Article 32 is not maintainable. The employee should consider civil or labour remedies; a writ under Article 226 would lie only if the bank discharges a public duty in the relevant respect. Which mistake would change the reasoning in this example? Treating "other authorities" as limited to sovereign bodies. Correction: the ejusdem generis reading was rejected; apply the Pradeep Kumar Biswas test. Assuming every company in which Government holds some shares is "State". Ask Course Tutor: please explain this step from the example. Reasoning: Apply Pradeep Kumar Biswas. Financial control: none. Functional control: banking is a commercial activity, not a governmental function. Why does it follow? Add what you tried, so the explanation addresses your difficulty. Now try the source practice. Which case laid down that a body is "State" if it is financially, functionally and administratively dominated by Government? Pause before the answer. The source answer is: Pradeep Kumar Biswas v. Indian Institute of Chemical Biology (2002), a seven-judge Bench decision. Compare your reasoning as well as the result. If your response differs, return to the worked example and identify the step that needs correction. Explain the key idea in your own words, revisit any mistaken step, then continue to the next lesson. Use Stop to end Course Tutor when you finish.
