Welcome to LLM — Technology Law. Follow Technology Law: advanced foundations, then practise in the learning system. Sign in and use the study header to open your authorised course. Select this published lesson. Start Course Tutor with Auto audio on: it teaches continuously, answers a typed question, then resumes. The third is the conditions. A marketplace platform receives three communications on the same day. Communication one: a letter from a law firm asserting that a product listing infringes its client's trade mark and demanding removal within twenty-four hours, failing which the platform will be joined as a defendant. Analysis. This is a private communication and is not actual knowledge in the sense that triggers loss of the exemption. The platform should not treat it as compelling removal, and should say so politely. The platform must operate its grievance mechanism and respond within the prescribed timeline, which is a separate obligation whose breach is a compliance failure even though the content stays up. And the platform's own terms of service may give it a contractual right to remove listings, which is a commercial decision distinct from the legal one. Advise the client to separate the three: the statutory position, the compliance obligation, and the contractual discretion. Communication two: an order of a competent court directing removal of a specified listing. Analysis. This is the category that triggers the obligation. Act expeditiously, record the time and manner of compliance, and preserve the material where preservation is required. Note the scope: comply with what the order says, neither less nor more, and do not treat it as authority to remove other material not covered. Communication three: a notification from a government agency under the blocking machinery. Analysis. This engages a distinct statutory procedure with its own confidentiality and process requirements. Verify that the communication is issued under that machinery and by the designated authority, and follow the prescribed procedure rather than the ordinary takedown workflow. Now the structural advice. The platform needs one workflow that classifies every incoming communication into these three categories at intake, because the legal consequences differ entirely and the error most platforms make is to treat all three the same. Nothing here is advice in any actual matter. Ask Course Tutor to explain this step: And the platform's own terms of service may give it a contractual right to remove listings, which is a commercial decision distinct from the legal one. Say what you tried. Pause and try this source task. Why is the narrow reading of actual knowledge justified? The source answer is: Because a private complaint would require the intermediary to adjudicate a contested legal claim it is not equipped to decide, and since it faces liability either way it would remove lawful material to be safe. Requiring a court order or an authorised government notification places the determination with a body competent to make it. Compare your method and result, correct an error, then continue.
