A decree is different. Here is an objective question of the kind used in preliminary examinations. Question. Which of the following is correct with regard to the Code of Civil Procedure 1908? Option A. A judgment is the formal expression of an adjudication which conclusively determines the rights of the parties. Option B. An order of rejection of a plaint is expressly excluded from the definition of decree. Option C. A decree is the formal expression of an adjudication which conclusively determines the rights of the parties with regard to all or any of the matters in controversy in the suit, and the rejection of a plaint is deemed to be a decree. Option D. Every order passed by a civil court is appealable. The correct answer is Option C. Let us work through the options. Option C reproduces section 2(2) faithfully. It captures the three ideas that examiners look for. There must be a formal expression. There must be a conclusive determination. It must concern the matters in controversy in the suit. It also captures the express inclusion of rejection of a plaint. Option A is wrong because it puts the definition of decree against the word judgment. A judgment is the statement of the grounds, under section 2(9). This swap is the single most common trap in this area. Option B is wrong because it states the opposite of the statute. Rejection of a plaint is included in the definition of decree, not excluded. What is excluded is any adjudication from which an appeal lies as an appeal from an order, and any order of dismissal for default. Option D is wrong because appeals from orders are restricted. Only the orders specified in section 104 and Order 43 Rule 1 are appealable. Remembering that appeals from decrees are general and appeals from orders are specific will protect you in many questions. Ask Course Tutor to explain this step: Option D. Every order passed by a civil court is appealable. The correct answer is Option C. Say what you tried. Pause and try this source task. Distinguish a decree from an order under the Code of Civil Procedure 1908, and state why the distinction matters for appeals. The source answer is: A decree under section 2(2) is the formal expression of an adjudication that conclusively determines the rights of the parties in the suit. An order under section 2(14) is the formal expression of any decision that is not a decree. The distinction matters because an appeal lies from a decree generally under section 96, whereas an appeal lies from an order only if that order is listed in section 104 or in Order 43 Rule 1. Compare your method and result, correct an error, then continue. Use Stop to end Course Tutor.
