Welcome to Judiciary Foundation. Follow Programme Reader 02 — Core Concepts & Vocabulary, then practise in the learning system. Sign in and use the study header to open your authorised course. Select this published lesson. Start Course Tutor with Auto audio on: it teaches continuously, answers a typed question, then resumes. A decree is the formal expression of an adjudication which conclusively determines the rights of the parties with regard to all or any of the matters in controversy in the suit. This is a preliminary style objective question. Which of the following statements correctly describes the relationship between a judgment and a decree under the Code of Civil Procedure 1908? Option A says a decree is the reasoning of the court, and a judgment is the formal expression drawn up afterwards. Option B says a judgment is the statement of the grounds of the decision, and the decree is the formal expression of the adjudication that conclusively determines the rights of the parties. Option C says every judgment must be followed by a decree, including a judgment in a criminal trial. Option D says a decree and an order are the same thing, because both are decisions of a civil court. The correct answer is Option B. Here is why each wrong option fails. Option A fails because it reverses the two terms. The reasoning is the judgment. The formal expression drawn up from that reasoning is the decree. Reversing them is the single most common error in this topic. Option C fails because a decree belongs to civil proceedings only. A criminal court delivers a judgment, and that judgment ends in conviction or acquittal, with a sentence where there is conviction. There is no decree in a criminal trial. Option D fails because the Code defines an order as the formal expression of a decision which is not a decree. The two are defined against each other. The practical consequence is different, because appeals from decrees and appeals from orders follow different provisions. Option B is correct because it tracks the statutory definitions and keeps the sequence right, which is judgment first and decree afterwards. Ask Course Tutor to explain this step: Option D says a decree and an order are the same thing, because both are decisions of a civil court. Say what you tried. Pause and try this source task. A civil court dismisses an application for amendment of a plaint. Is that decision a decree or an order, and why does the answer matter? The source answer is: It is an order, because it does not conclusively determine the rights of the parties in the suit itself. The suit continues after the decision. The answer matters because an appeal from a decree lies under Section 96 of the Code of Civil Procedure 1908, while an appeal from an order lies only if that order appears in the list in Order 43. Compare your method and result, correct an error, then continue. Use Stop to end Course Tutor.
